These Terms of Service ("Terms") govern your access to and use of the OpenSEO instance hosted at seo.ascendifynow.com ("the Service"), operated by Ascendify ("the Operator", "we", "us"). By accessing or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be authorized to use any third-party accounts (such as Google Search Console or Analytics) that you connect.

2. Acceptable use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
Attempt to gain unauthorized access to the Service, its data, or its infrastructure;
Interfere with or disrupt the integrity or performance of the Service;
Use the Service to infringe the rights of others or to abuse third-party APIs.

3. Third-party services and data

The Service integrates with third-party providers including DataForSEO and Google APIs. Your use of those integrations is also subject to the respective providers' terms. Usage-based data costs (e.g. DataForSEO credits) are the responsibility of the Operator's account holder unless otherwise agreed.

4. Intellectual property

OpenSEO is open-source software provided under its own license. These Terms govern the operation of this particular hosted instance, not the underlying open-source project. Data you create remains yours.

5. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. SEO metrics and third-party data are provided for informational purposes and are not guaranteed to be accurate or complete.

6. Limitation of liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

7. Termination

We may suspend or terminate access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to the Service or other users. You may stop using the Service and request account deletion at any time.

8. Changes to these Terms

We may modify these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.
